Designer files millionaire lawsuit against Flamingo and sports equipment company for plagiarism

Flamengo’s board of directors sees the club embroiled in another controversy, and this time the Mais Querido name has been embroiled in a lawsuit brought by designer Felipe Silva, of Florianópolis, who alleges that the Brazilians, a sporting goods company, plagiarized several designs from T-shirts they made. by him and market them as licensed products. Among the models that could have been copied was a flamingo shirt.

The designer has designed the shirts of some Serie A clubs as part of the Design Completion (TCC) work titled “If Nike is the sponsor of the Brazilian Championship?” After the project was approved, Felipe showed the models on social media. “My designs were for an academic project, where they were submitted to a supervisor, approved by the board of directors and also by an academic institution. And when I posted on social media, I always made it clear that it wasn’t a store and I didn’t sell T-shirts and that they were just dummy projects.”

What Felipe didn’t expect was that two years later, while looking for T-shirts to give away for Christmas, he would find pieces similar to the ones he had developed. “They were products licensed by several Brazilian clubs and developed, manufactured and marketed by Braziline. I looked for a lawyer and we initiated an extrajudicial notice for the company as well as for the clubs that licensed the brand. They were profiting commercially from the T-shirts in their official stores.

Felipe then decided to file a lawsuit against the company for 1.9 million Brazilian riyals, and again against Flamengo for 1.5 million Brazilian reais. In addition to the Flamengo, Atlético-MG, Botafogo, Cruzeiro and Vasco will use the same pattern. According to Felipe’s lawyer, Hugo Litao, who specializes in intellectual property, the intent is to open one per club. “There are likely to be many actions, however, and we started against Flamengo, who sell the shirt in their shop and the profit is 100% for them. Braziline was contacted by GE, who claimed the author had “abandoned” the procedure. “There was no plagiarism, but we cannot comment on the processes in progress, but I can say that it is an old process, which was already reported a few months ago, including the author’s withdrawal from the proposed procedure in Rio de Janeiro.”
