Portuguese court orders victim to compensate burglar who robbed his home – Metro World News Brasil

A decision by Portugal’s Supreme Court of Justice is giving the internet something to talk about. In the city of Guimarães, a robbery victim was ordered to compensate the assailant with approximately 30,000 euros, approximately R$163,000.

And according to the decision he commented on the worldthe court understood the case as a case involving “excessive self-defense” because the ratio between the damage caused by the aggressor was less than the material damage he suffered, which was run over by the property owner.

The 19-year-old sustained fractures to both legs and his right ankle, in addition to head injuries. Through the attacker’s objection, the property owner avoided losing two silver coins with a total value of €680, roughly R$3,700.

The case was reported in 2019, when his wife informed the landlord of the presence of another man inside their home.

Faced with an alert, he finds the masked attacker and gets the man to start running away. After recovering from surgery and unable to move normally, the property owner used his vehicle to pursue the attacker, who was located and ran over.

As a result, the attacker was taken to hospital where he was immobilized for 90 days to recover from the damage he sustained from the hit-and-run.

In the decision, handed down by the Supreme Court of Justice of Portugal, it is possible to read: “A mere state of tension, inherent in a person who has caught an intruder robbing his house and pursues him, trying to prevent him from escaping, does not involve a degree of disturbance, much less, fear.” which justifies conduct in which the defender is not aware of the apparent disparity in the value of the goods at stake compared to the interests protected, where the verified state of tension is not sufficient to legitimize the overly defensive action.”

Despite this, the offender was found guilty of aggravated robbery.
