A Dpvat waiver can happen because you already have enough resources to pay for insurance over the next year.

Funds have accumulated in amounts already paid by car owners in the past years.
This year the fee is no longer there for the same reason either. In addition, there are reports of irregularities by Seguradora Líder, formed by 40 companies in the insurance market.
Thus, Dpvat’s resources have to be paid through the compensation values for traffic accidents over the previous years.
As per Dpvat rules, the maximum compensation today is R$13,500. The exemption from paying Dpvat next year was announced by the Private Insurance Supervisory Authority (SUSEP) in November.
Although, the final decision will also depend on the opinion of the National Council on Private Insurance (CNSP). There is still no definitive date for discussion regarding the Dpvat 2022 waiver to be definitively concluded.
The suspension of Dpvat has been in effect since 2020. This is because SUSEP claimed that the government had enough cash to pay for Dpvat. As a result of compensating traffic accident victims, amounts exceeding 7.5 billion Brazilian riyals.
Since the dissolution of Seguradora Líder, Caixa Econômica Federal has been responsible for paying accident compensation from January 2021 onwards.
