Texas Pete hot sauce brand and its parent company, TW Garner Food Co., can now breathe a sigh of relief as a lawsuit that accused them of deceptive labeling has been dismissed. The lawsuit, which was originally filed in September 2022, caught the attention of hot sauce enthusiasts across the country.

The plaintiff, Phillip White from California, alleged that he was misled by Texas Pete’s labeling, leading him to believe that the hot sauce was made in Texas when it was actually manufactured in Winston-Salem, North Carolina. White argued that he would have paid less for the product if he had known its true origins.

TW Garner Food Co., however, maintained that their product labels and trademark were transparent and not misleading in any way. They stood their ground throughout the legal process, asserting that their claims were truthful.

Delving into the specifics of the case, it was revealed that the court dismissed the lawsuit after the plaintiff, Phillip White, filed a motion to dismiss it. The reasons behind White’s decision to drop the lawsuit were not disclosed.

Following the dismissal, Ann Garner Riddle, the President and CEO of TW Garner Food Co., expressed her satisfaction, stating that the company had remained resolute in their position throughout the legal proceedings. This positive outcome brings a sense of vindication to the hot sauce manufacturer.
