GOL will have to compensate employees

GOL Linhas Aéreas has been indicted by the Labor Court in a class action lawsuit brought by the MPT (Ministry of Public Labor) regarding the requirement that female employees wear make-up. The company did not provide any assistance or compensation for this.

The information is from the SNA (National Aeronautics Association), who was involved in the case as an assistant. In addition to make-up and waxing, the procedure includes aesthetic procedures, such as manicures and the use of accessories.

Sought by Folha de S.Paulo, the company has not commented on the decision. According to the lower court decision, the GOL will have to pay compensation for the expenses of personal appearance as well as provide the means to comply with the dress code and presentation.

The resolution provides for the payment of compensation in the amount of R$220 per month to each airline employee (excluding installments prior to 9/21/2015 and employment contracts terminated until 9/21/2018). The company was also ordered to pay compensation of R$500,000 for collective moral damages “in light of behavior that has led to gender discrimination and a reduction in women’s salaries”.

If there was no compensation or offer, the court decided that GOL should refrain from demanding aesthetic procedures and acquiring cosmetics from employees, so as not to incur expenses for workers.

GOL’s requests for clarification were judged unfounded. Punishment must be executed after the final and non-appealable decision of the case.
